Terms & Conditions

1. The Promoter and Participant

1.1. The promoter is Tilda Limited, a private limited company registered in England and Wales with Company number 00990202 with its registered office situated at Coldharbour Lane, Rainham, Essex, RM13 9YQ (referred to in these Terms as ‘Promoter’, ‘us’ or ‘we’).

1.2. A participant is any natural person satisfying the criteria under condition 4 and taking part in the Promotion offer (referred in these Terms as ‘Participant’, ‘you’, or ‘claimant’).

2. The Promotion

2.1. The title of the promotion is Tilda Tasty Sides Try Me Free.

2.2. By taking part in the Promotion an eligible participant has the opportunity to be reimbursed the purchase price of a Qualifying Product up to a maximum refund of £2.00 for the UK / 2.40€ for ROI by completing a claim form on the Promoter’s website stated at condition 3.7 (c) below (‘Claim’).

3. How to participate

3.1. The Promotion will run from 00:01 BST on 22 January 2024 to 23:59 BST on 30 June 2024 inclusive (the “Promotion Period”).

3.2. A Qualifying Product (defined below) must be purchased by you before the Promotion Period ends.

3.3. A Qualifying Product means any of the following bearing the ‘Try Me Free’ promotional sticker:

  1. Tilda Tasty Sides Chinese Black Bean 250g; or
  2. Tilda Tasty Sides Indian Black Dhal 250g; or
  3. Tilda Tasty Sides Mexican Fajita 250g; or
  4. Tilda Tasty Sides Thai Green Curry 250g.

3.4. Purchase by you of any other product of the Promoter other than the purchase of a Qualifying Product will not entitle you to take part in the Promotion offer.

3.5. After purchasing a Qualifying Product during the Promotion Period, a Participant wishing to make a Claim must do so during the period starting 00:01 BST on 22 January 2024 and ending at 23:59 BST on 30 June 2024 (the ‘Claim Period’).

3.6. All Claims must be received by the Promoter before the end of the Claim Period. All Claims received by the Promoter after the Claim Period are automatically disqualified.

3.7. To participate:

  1. access to the internet will be required;
  2. a purchase of a Qualifying Product before the end of the Promotion Period will need to be made by you;
  3. before the end of the Claim Period a participant will be required to visit the Promoter’s website at www.tilda-trymefree.com and complete the claim form by providing their full name, postcode and house number, email address; bank account details comprising the account number and sort code or PayPal account email. A participant’s name on the Claim must match the name on the bank account provided;
  4. you will upload, in .PNG, JPEG, .BMP, or .PDF format (such not to exceed a maximum file size of 10MB) a clear copy of a receipt of the Qualifying Product purchased, ensuring that details of the purchase price, name and branch of the retailer and the date of purchase are all clearly identifiable. The receipt should be dated on any date within the Promotion Date; and
  5. a claimant may redact all other information on the receipt other than as is required under condition 3.7 (d) above before uploading the receipt as proof of purchase and any information redacted on the receipt which relates to the Qualifying Product will render the Claim void.

3.8. The Promoter will not accept:

  1. responsibility for any claims that are inaccurate, delayed or illegible regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
  2. proof of transmission as proof of receipt by the Promoter of a Claim.

3.9. By submitting a Claim, you are agreeing to be bound by these Terms.

3.10. By participating in the Promotion, a participant’s statutory rights will not be affected and shall remain in addition to any other rights.

4. Eligibility

4.1. The Promotion is only open to all residents in the United Kingdom (UK) and the Republic of Ireland (ROI) aged 18 years or over, except:

  1. employees of the Promoter or its holding or subsidiary companies;
  2. employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the competition or its administration; or
  3. members of the immediate families or households of (a) and (b) above.

4.2. In taking part in the Promotion, you confirm that you are eligible to do so and eligible to make a Claim. The Promoter may require you to provide proof that you are eligible to enter the Promotion.

4.3. The Promoter will not accept Claims that are:

  1. automatically generated by computer or created by artificial intelligence (including but not limited to chatbots such as ChatGPT or similar software applications;
  2. completed by third parties or in bulk;
  3. illegible, have been altered, reconstructed, forged or tampered with or incomplete; and
  4. from anyone other than consumers. Only natural persons participating as consumers are able to make a Claim and if the Promoter or its agent (VCG The Promo Risk People Limited) suspect a participant is in breach of this condition, the participant’s claims will be deemed invalid.

4.4. There is a limit of one Claim entry per household. Claims made on behalf of another person will not be accepted and joint submissions are not allowed.

4.5. The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the Promotion.

5. Claim status notification and payment

5.1. Claimants will be notified via the email address provided if the Claim is successful/unsuccessful within 14 days of claim submission. The Promoter reserves the right to ask for additional identification of a participant if the Promoter reasonably thinks a claimant is trying to claim more than one redemption per household for the same address.

5.2. If a claimant’s Claim is accepted the refund of the purchase price of a Qualifying Product up to a maximum of £2 for the UK / 2.40€ for ROI will be transferred into your nominated bank account or PayPal account within 28 days of confirmation of the successful Claim.

5.3. The Promoter’s decision is final and the Promoter will not enter into correspondence on any invalid Claim.

6. Limitation of liability

The Promoter and its associated agencies and companies shall not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with the Promotion, except for any liability which cannot be excluded by law in which case that liability is limited to the minimum allowable by law.

7. Data protection and privacy

The Promoter will only use the personal details supplied for the administration of the Promotion and for no other purpose, unless the Promoter has your consent. At all times a participant’s personal data will be kept confidential and held in accordance with both current data protection legislation and the Promoter’s privacy policy. The privacy policy states that the Promoter may supply your personal data to its third-party agency, VCG The PromoRisk People Limited solely for the purposes of administering the Promotion. Personal data will be stored for three months after the close of the Promotion before deletion. Any participant can request access to his/her personal data, or have any inaccuracies rectified, by sending an email to hello@tilda.com. By participating in the Promotion, you agree to the use of your personal data for the purpose as described here.

8. General

8.1. If there is any reason to believe that there has been a breach by you of these Terms, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the Promotion.

8.2. The Promoter has no control over internet or communication networks and shall not be liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter will not be held liable to any individual for any fraud committed by any third party nor for any event beyond its control including, but not limited to, user error and any network, computer, hardware or software failures of any kind which may restrict, delay or prevent participation in the Promotion.

8.3. The Promoter reserves the right to verify all Claim applications and to refuse to award claims where there are reasonable grounds to believe there has been a breach of these Terms or any instructions forming part of this Promotion’s requirements, the spirit of the promotion, any instructions forming part of this Promotion’s claim requirements claimed using fraudulent means.

8.4. The Promoter reserves the right to hold void, suspend, cancel, or amend these Terms and/or terminate the Promotion if it becomes necessary to do so due to circumstances beyond its reasonable control.

8.5. If any If any provision of these Terms (or part of a provision) is found by any court or administrative body of competent jurisdiction to be invalid, unenforceable or illegal, the other provisions shall remain in force.

8.6. If any invalid, unenforceable or illegal provision would be valid, enforceable or legal if some part of it were deleted, the provision shall apply with whatever modification is necessary to give effect to the commercial intention of the Promoter.

8.7. These Terms are governed by English law. If any entrants to this Promotion wish to take court proceedings, then they must do this within the courts in the United Kingdom.
